After Adam and Eve were cast out of the Garden of Eden, why didn't Cain receive the death penalty for killing his brother Abel? Throughout the book of Genesis mankind had free will after they were separated from God because of disobedience in the Garden of Eden, so they did their own thing. They had free-will to do good or bad at that time because the law had not been given by God yet. It was give to Moses in the book of Exodus - that's when mankind came under condemnation for breaking those laws. He knew they couldn't keep them - that's why blood sacrifices were required as a temporal substitute until the birth and the shedding of the blood of our Savior Jesus Christ on the Cross.
